The 5,000 sq ft line: Table 4.1 of Sec. 9-1-42 lists 'Health clubs, martial arts studios, and dance studios' under 5,000 sq ft as a minor use permit (M) in the CN, CC, CO, BP and MU-TC districts, and over 5,000 sq ft as a use permit (U). Under Sec. 9-1-114.2(c) the director decides minor use permits administratively, while use permits go to a Planning Commission hearing. Size the premises with this line in mind; a 5,200 sq ft studio takes the longer path.

Larger recreation formats: indoor commercial recreation centers are allowed only by use permit in CC, BP and MU-TC and are prohibited in CN and CO (Table 4.1), so a climbing gym, trampoline park or similar concept needs a site in one of those three districts. Confirm the district on the City's zoning map before touring.

Parking: Table 6.5 (Sec. 9-1-66) requires 1 space per 150 sq ft for health clubs and spas, counts pool area as floor area, and requires the applicant to submit a parking study. General retail in the same center is parked at 1 per 200, so a 4,000 sq ft studio needs about 27 spaces against 20 for retail. Centers with 400 or more spaces and a mix of uses can take up to a 25 percent shared-parking discount (Sec. 9-1-66(b)).

Noise and vibration: exterior noise at residential property is limited to 55 dB(A) from 7 a.m. to 10 p.m. and 50 dB(A) at night, reduced by 5 dB(A) for impact noise or music (Sec. 6-6-5), which applies to 5:30 a.m. classes near homes. Sec. 9-1-45.21(6) also bars any use from creating recurring ground vibration perceptible at the lot line, which bears on dropped weights and HIIT on a slab-on-grade suite.

Opening steps: a certificate of occupancy is required for any change in use of a tenant space (Sec. 9-1-114.9(b)(3)), and a minor use permit or use permit lapses after two years if the studio has not opened (Sec. 9-1-113.5). Make the permit and certificate conditions of rent commencement.

Co-tenancy check: Club Pilates and 9Round already share 30100 Town Center Drive, and F45 and StretchLab are neighbors on Golden Lantern. Review the landlord's existing exclusives before proposing a similar format in either spot.
