What to diligence before LOI

  1. 01

Child care zoning: the use table in Municipal Code Section 9.11.015 lists day care centers as "C" (conditional use permit) in all five commercial and office zones: CN, CC, CH, CR and OP. Conditional use permits are handled under Chapter 9.48. Budget time for a public hearing even in a center that already has a preschool.

  2. 02

Tutoring classification: Section 9.11.015 has no row for tutoring or learning centers. Private schools are prohibited in CN, CC, CH and CR and conditional only in OP, and unlisted uses depend on the Director finding them similar to a listed use. Ask Planning for a written determination of how your tutoring or enrichment concept is classified before signing, even though Kumon and Sylvan already operate in Mission Viejo Village, Portola Plaza and Plaza del Lago.

  3. 03

Parking: Section 9.25.020 requires 1 space per staff member plus 1 space per 6 children for a nursery or preschool, and 1 space per 1.5 students for business, professional or trade schools. Check that the center's parking can absorb that without a variance, especially at restaurant-heavy Plaza del Lago.

  4. 04

State licensing space: 22 CCR 101238.3 requires 35 sq ft of indoor activity space per child and 22 CCR 101238.2 requires 75 sq ft of outdoor space per child inside a fence at least four feet high. At the 116-child capacity of Happy Minds in Gateway Center, that is 4,060 sq ft of countable indoor activity space and 8,700 sq ft of outdoor play area, so ask the landlord early where a play yard could go.

  5. 05

Existing building vs. expansion: Section 9.11.010 says a use going into an existing structure with no enlargement follows the chapter's standards, while enlarging the structure or building new requires a planned development permit under Chapter 9.47. Adding a shade structure or enclosing a play yard may raise that question.

  6. 06

Fire clearance: 22 CCR 101171 requires a fire clearance for every child care center. Make the CUP, fire clearance and CDSS license all conditions of the lease commencing.
