Size and bar: Municipal Code Section 9.11.015 permits restaurants under 4,000 sq ft (excluding drive-thrus) in all five commercial and office zones and makes restaurants over 4,000 sq ft conditional. A bar inside a restaurant is conditional (C) everywhere, and dancing and live entertainment is prohibited in CN and conditional elsewhere. A 4,500 sq ft second-generation space is a CUP deal even with no alcohol.

Alcohol means a CUP: Section 9.11.020(c)(1) requires a conditional use permit for any business selling alcohol under a state ABC license, including an original or new license, a change of license type, a premises-to-premises transfer, more floor area, a new floor plan, or live entertainment (which the code defines to include recorded music with a DJ and televised sports). The police department reviews the application, and exterior alcohol advertising is banned. If the prior tenant stopped using its license for 30 days or vacated, the new operator needs its own CUP (Section 9.11.020(c)(1)(a)(viii)). Budget a Design Review Committee meeting and a Planning Commission hearing (Sections 9.48.015 and 9.48.020).

ABC license type: California ABC issues Type 41 (On-Sale Beer and Wine, Eating Place) and Type 47 (On-Sale General, Eating Place) to restaurants. Both require a bona fide eating place with a working kitchen and real meal sales, both allow minors, and both require servers and their managers to hold Responsible Beverage Service certification. Pick the type before the City CUP, because a later change of type triggers a new CUP.

Patio and parking: Section 9.11.020(a)(2)(a) requires uses to operate indoors, and a patio needs a planned development permit. Section 9.25.020 counts outdoor seating as floor area and requires 1 space per 100 sq ft of public seating area up to 4,000 sq ft, plus 1 per 80 sq ft above that, with a 10-space minimum. In restaurant-heavy centers such as Plaza del Lago and Mission Viejo Village, ask for the center's parking count and any shared parking agreement under Section 9.25.030(n).

Kitchen approvals: OC Health Care Agency's Plan Check unit must approve plans for every new or remodeled food facility (Health and Safety Code 114380) before construction, and the health permit is issued at final inspection. Mission Viejo is served by more than one water and sewer district. Santa Margarita Water District runs a FOG program for food service establishments with grease interceptor sizing guidance, so confirm the district for the address and whether the existing interceptor meets its rules before relying on a second-generation kitchen.

Opening timeline: Chapter 9.41 requires a certificate of occupancy before a new use opens, filed at least 30 days ahead for a change in occupancy (Section 9.41.015(b)), and before reopening when a restaurant changes hands (Section 9.41.015(c)). The City can require a deposit to guarantee the conditions of approval (Section 9.41.015(d)). Make the CUP, the HCA permit and the certificate conditions of rent commencement.
