What to diligence before LOI

  1. 01

Zone first: Fullerton's code has no separate grocery line, so a grocer falls under 'Retail and service uses', which FMC 15.30.030.2 and 15.30.030.3 permit by right in G-C and C-3. The C-M list (15.30.030.4) does not include general retail, and 15.30.030(A) treats any unlisted use as not permitted unless the Director finds it similar to a listed one. A pharmacy counter is by right in G-C and C-3 and a CUP in O-P.

  2. 02

Beer and wine: FMC Chapter 15.31 covers on-site alcohol sales only, and the commercial use lists do not carry a separate line for off-site sales. Ask Planning in writing whether a grocer's off-sale license needs any city approval before assuming it does not.

  3. 03

Parking: Table 15.30.060(A) requires 1 space per 250 sq ft for commercial uses, so the 57,560 sq ft Albertsons at Amerige Heights carries a 231-space requirement on its own, and 15.30.060(D)(1) adds up every use on a site. Under 15.30.060(E), re-tenanting an existing building with a by-right use needs no added parking if the building is not expanded and the property has no open code enforcement case, which helps when backfilling a grocery box.

  4. 04

Fullerton Town Center: NewMark Merrill's page still shows an Amazon Fresh logo, but Amazon announced on January 27, 2026 that it would close all of its physical Amazon Fresh stores. Confirm with the manager whether that box is dark, re-leased or converting, since a closed Amazon Fresh would put a grocery-sized box back on the market in the city.

  5. 05

Amerige Heights Town Center: Regency owns 96,942 sq ft, while Target, McDonald's, KFC and Islands are separate parcels on the site plan. Ask Regency for the Albertsons use restrictions and any reciprocal easement limits before proposing a food, pharmacy or specialty grocery use there.

  6. 06

Exterior work: FMC 15.30.045 puts any proposed construction in a commercial zone through site plan review under Chapter 15.47, so a new storefront, pad or expansion for a grocer adds a city review step to the schedule.
