What to diligence before LOI

  1. 01

A supermarket needs a CUP: Table 18.12-1 (Section 18.12.050) lists 'Supermarket' as a conditional use in the C-N and C-G zones and prohibited in C-O. The Planning Commission holds the hearing (Section 18.36.230) and acts within 21 days after it closes (18.36.240.A), with appeal to the City Council. The code's 'Retail food' category means prepared food for take-out (Section 18.04), so a specialty or small-format grocer should get Planning's classification in writing.

  2. 02

Beer and wine: 'Alcoholic beverage sales, accessory' is also a conditional use in C-N and C-G (Table 18.12-1). If the grocer sells alcohol, file both requests together so there is one hearing.

  3. 03

Taking over a grocery box: a CUP runs with the land (Section 18.36.280), but the Planning Commission can terminate it if the use has been inoperative for six consecutive months (18.36.270.A.1). A new CUP lapses one year after it takes effect unless building permits are issued and work starts (18.36.255). Ask the landlord for the site's CUP history before you sign on a dark store.

  4. 04

Parking under Table 18.22-1 (Section 18.22.030): a food store or supermarket parks at 1 space per 150 sq ft, while a shopping center of 25,000 sq ft or more parks at 5 spaces per 1,000 sq ft for mixed occupancies (18.22.030.A.5). A 30,000 sq ft market would need 200 spaces standing alone, or 150 counted at the center rate.

  5. 05

Outdoor sales and screening: Section 18.12.070.C requires display, storage and sales inside a fully enclosed building, and outdoor sales need a Planning Commission CUP. Where a center abuts a residential zone, Section 18.12.070.A requires a 50-foot building setback and 18.12.080.B a six-foot masonry wall with 15 feet of screen landscaping, which matters for truck docks.

  6. 06

Specific plan and PD sites: the city publishes a Yorba Linda Town Center Specific Plan and separate maps for PD-1 through PD-30. If the parcel is in one of those, its own use list may govern instead of Table 18.12-1, so confirm the governing document on the city's Map Yorba Linda GIS.
