What to diligence before LOI

  1. 01

Drive-through permit: Section 9-3.512 limits drive-through facilities to the NC, GC, OC, CM, PC and Industrial districts and requires a discretionary use permit approved by the City Council, which applies to banks and pharmacies as well as restaurants. Table 3-4 bars drive-throughs in the Town Center (TC) district and marks them 'C' in Town Center Edge (TCE), which the section's district list leaves out, so a TCE pad near downtown needs a written answer from Planning first.

  2. 02

Traffic study before the hearing: 9-3.512(d) requires a traffic impact analysis under Administrative Policy 310 covering menu items, order processing time, arrival rates, hours, stacking lane length and width, and existing volumes, speeds, sight lines and three years of accident data within 1,000 feet, no more than 12 months old. The mitigation plan must keep 100% of stacking lane traffic off the streets 100% of the time. Budget the study and a Council hearing into the pad timeline.

  3. 03

Site design under 9-3.512(e): franchise or branded architecture is strongly discouraged in favor of the City's Architectural Design Guidelines, a single-lot pad should have one curb cut to the arterial, driveways max out at 35 feet at the sidewalk, menu boards must be screened from the street, and stacking lanes must be screened with landscaping. Drive-through parking is 1 space per 4 patrons of restaurant capacity plus 1 per employee per shift.

  4. 04

Parking and pad size: Table 3-34 sets restaurants at 1 space per 40 sq ft of dining area and takeout food without a drive-thru at 1 per 50 sq ft of floor area, each with an 8-space minimum, and Table 3-35 sets banks with teller windows at 1 per 200 sq ft. Table 3-5 caps first-floor FAR at 0.25 in NC (with a 5-acre minimum lot) and 0.40 in GC, so check how much floor area an existing center has left before promising a new pad.

  5. 05

Fuel and auto service pads: Table 3-4 allows gasoline or fuel dispensing only in NC and GC with a CUP under Section 9-3.541, and automatic car washes only in GC with a CUP and only alongside a fuel station. Vehicle repair is not listed in the commercial table; Table 3-6 allows repair uses (including muffler, brake and transmission work) by right in the CM and IP industrial districts, all inside a building with no outside storage.

  6. 06

Traffic counts from Caltrans (2024 AADT): Ortega Highway (SR-74) carries 46,600 vehicles a day just east of I-5 and 41,800 east of Calle Entradero, and I-5 carries 168,400 south of the Ortega interchange and 175,000 north of it. We found no City count for Del Obispo Street or Camino Capistrano. For food pads, the Santa Margarita Water District (which has run the City's sewer since November 2021) administers the grease program under its Ordinance No. 2012-05-01, and the OC Health Care Agency's Plan Check unit reviews every new food facility.
